Prove generation on first tag push always fails

There is a bug somewhere that causes provenance generation to fail when the repo:
a) has no tags or
b) the previous tag has no provenance
c) or the tag commit has no provenance

It is one or more of these conditions, or a combination of them. This is the second time i've hit this error, so I now know it is a bug:
